개헌이 재앙의 초대장일 수는 없다 -동성애·동성혼 개헌의 정당성 결여를 중심으로- = Constitutional Amendment Ought Not To Be An Invitation To Disaster

지금 우리나라에서는 심각한 안보·경제 위기에도 불구하고 정부형태 변경 중심의 개헌 논의가 심각하게 추진되고 있다. 그리고 이 개헌운동에 편승해 정부형태 외의 다양한 항목의 개헌 논의도 또한 진행되고 있다. 국가인권위원회 헌법기관화 및 동성애·동성혼 합헌법화가 대표적인 개헌논의 항목 가운데 하나다.
정부형태 개헌주장의 가장 강력한 정당성근거 하나로 제왕적 대통령제를 고치자는 것을 든다. 그러나 현행 5년 단임의 대통령제의 제왕적 대통령제화는 결코 헌법문서가 아니라 대통령으로 하여금 제왕적으로 군임 할 수 있게 만드는 헌법의 운영 즉 정치관행, 정치문화 때문이다. 헌법조문 상 미국헌법은 행정권을 대통령에게 부여하고 있는데 우리 헌법은 정부에 주고 있다. 조문 상 행정권은 의장인 대통령과 국무총리 등 국무위원으로 구성된 국무회의 중심으로 즉 각료(장관)와 팀웍을 구성해 행정권을 행사하게 되어 있다. 그러나 실제는 대통령과 그 명령을 떠받드는 청와대참모진(사실상의 제2의 행정부)이 행정권을 사실상 행사하고 국무총리·각료로 구성된 제1의 행정부는 마치 그 집행기관과 같이 작용한다. 개헌안 중 인기 있는 연임이 가능한 4년임기의 대통령제라도 정치관행·정치문화가 바뀌지 않는 한 사정은 마치가지일 것이다. 1960-61의 경험과 계파로 구성된 정당의 현실에 비추어 내각책임제는 안정된 일하는 정부를 만들기는 힘들다. 둘 다 실권을 가지는 대통령과 국무 총리로 구성되는 2원집정제는 특히 여소야대의 경우같이 두 사람이 충돌하는 경우에 이를 조정하는 장치가 없다.
그러한 만큼 정부형태 중심의 개헌은 정당화하기 힘들다. 제왕적 대통령제화를 포함해 지적하는 문제점들은 헌법이 아니라 정부조직법, 정당법, 선거법, 정치자금법, 정치관행, 정치문화를 개혁함으로써 바로 잡을 수 있는 사항들이다. 직면한 안보·경제 위기의 극복에 쏟아야할 국민적 에너지를 개헌에 쏟게 만든다는 점에서도 개헌은 정당화될 수 없다. 튼튼한 국가와 사회의 기초인 가족제도를 허무는 동성애·동성혼 합헌법화 개헌의 구실을 준다는 의미에서도 개헌은 정당화될 수 없다.
입법으로 창조된 국가인권위원회는 그 인권옹호 기능이 자유와 권리 주장을 위해 적극적·능동적으로 행동하는 국민(시민)의 기능·역할과 역시 인권옹호기능이 존재이유인 국가기관(국회·행정부·사법부)의 그것과 중첩적이기 때문에 우선 불필요하고, 그리고 상충하는 경우에 이를 조정하는 견제와 균형 원리와 같은 헌법적 통제장치가 없다는 점에서 헌법기관화의 합리성(필요성)과 정당성(justification)을 결한다. 그 구성은 헌법재판소의 그것과 유사하게 외형상 중립성을 유지할 수 있도록 되어있고 또 법적으로 독립성도 갖추게 되어 있지만, 국회 선출과 같은 민주적 정당성(legitimacy)도 없으면서 재판관에게 요구되는 법관자격 같이 그들의 업무를 이념·정치로부터 독립케 만드는 장치(법의 지배)도 없다는 점에서 더욱 그렇다. 과거의 그들의 업무를 보면 진보이념에 치중되어 왔으며 북한의 인권옹호를 위해서 일해 본 적이 없다는 점은 그 증거다.
국가기관에 대한 그들의 업무간섭(즉 결정)은, 즉 조사, 연구, 교육, 의견제시, 판단, 구제 등의 결정은 좁은 의미의 법적 구속력은 없지만 사실상의 구속력을 행사하는 경우가 많다. 그 결정을 통해 국가인권위원회는 그 독립성을 이유로 국회·행정부·사법부로부터 간섭(통제)은 받지 않으면서 그들의 업무는 간섭(통제)할 수 있다. 국가인권위원회 헌법기관화는 이 같은 헌법적 정당성 및 민주적 정당성의 결여 때문에 정당화될 수 없다. “성적 지향”(국가인권위원회법), 가족제도의 기초인 “양성평등” 대신 “성평등” 및 “국민” 대신 “모든 사람”(그들이 제안한 개헌안), “성소수자” 등의 외형상 무해해 보이는 용어의 사용과 개헌안 제안, 외국의 사례를 인용하면서 동성애·동성혼 합헌법화의 우회로를 제공하고 있다는 점에서도 그 헌법기관화를 옳다고 말할 수 없다. 동성애·동성혼을 받아들이는 의식구조의 변화와 함께 이를 승인하는 법원판례가 생길 수는 있다. 이러한 의미의 동성애·동성혼의 합법화는 혹시 있을 수 있다. 그러나 그 합법화와 헌법화는 차원이 다른 이야기다. 동성애·동성혼을 전국가적·초국가적인 천부의 자연법·자연권(헌법을 보장하는 인권)의 범주에 속한다고 할 수 없다. 우리나라에서 자주 인용하는 동성애·동성혼의 외국 사례는 주로 판례나 지방(주)법 차원의 합법화 사례지 우리가 자주 참조하는 영·미·불·독·일에서 동성애·동성혼의 성문 헌법화 사례는 없다. 또 동성애·동성혼 합헌법화는 지금까지의 군대 내에서의 동성애 처벌하던 군형법조항을 위헌·무효화에 이르게 하리라. 근래 우리나라는 급격한 출생율 저하로 생산인력·병력자원의 감소, 노령화사회등장 등 급속한 인구감소현상에 직면해서 출생을 장려하는 출산수당, 아동수당, 어린이집개설 등의 사회보장적 공공정책을 펴고 있다. 출생율감소에 기여하는 것임에 틀림없는 동성애·동성혼, 합법화는 물론, 합헌법화는 우리나라 공동체의 생존과 번영을 위한 이러한 공공의 이익과 정면으로 충돌한다. 그러한 까닭에 동성애·동성혼의 합헌법화를 위한 개헌은 정당화될 수 없다.
동성애·동성혼을 합헌으로 만드는 헌법조항이 없다고 성소수자에 대한 편견이나 차별이 생기는 것은 전혀 아니다. 이러한 편견이나 차별은 사회적 승인 즉 의식구조의 문제다. 성소수자에 관한 사회적 승인 즉 의식구조의 변화가 생긴다면 그것을 수용하기에 충분하리만큼 탄력적으로 작용할 수 있는 추상적 개방적인 인권관련 조항들을 현행헌법은 지니고 있다. 제10조 인간의 존엄과 가치·행복추구권, 제11조 평등조항 및 제37조제1항 등이 그러하다. 동성애·동성혼 헌법화 개헌은 불필요하다.
Attempts to change the present 5-years-one-term-only presidential form of government either into 4-years-two-terms presidential, parliamentary, or dual executive form of government have seriously been made for some time by way of constitutional amendment, despite the urgent national security and economic crises. The ideas of making the legislation created National Human Rights Commission as a constitutionally endorsed organ and elevating homo sexuality to relevant constitutional provisions, among many others, have also been put forward to hot items for constitutional amendment taking advantage of the major amending movements.
“Despotic” presidentship of the present government has been cited as one of the major rationales to amend the Constitution. The despotic tendency is, if there is, however, caused more by the traditional culture bound political practices expressed in loyal attendants-to-their-leaders relationship as in immediate staffs to the president and in the de-facto secondarily positioned cabinet members to the president and to his staffs, faction-bound party organizations, top-down nomination of parliamentary candidates, and many other factors, than the Constitution. Thus, cures for the despotic presidentship and others ought to be made through relevant statutory changes in the government organization act, public election laws, political parties act, political financing act, and others rather than constitutional amendment. Moreover, time and national energy consuming constitutional amendment ought not to be ever attempted in this time of critical national security and economic crises. Most of all, constitutional amendment ought not to be pursued in order not to provide an excellent pretext and leeway to those who seek really hard to realize their ideas of making the Commission as the constitutionally endorsed organ and the cause of homo sexuality as into constitutional provisions.
The Human Rights Commission ought not to be made a constitutionally created organ on the grounds that firstly it lacks constitutional justification in terms of constitutionalism and secondly democratic legitimacy in its construction as follows: Its major functions, that is, protection of human rights are redundant with the positive and active roles of the citizens in democratic process and with the (human rights protection) functions of the state(the National Assembly, the Administration, the Judiciary). There will be no check and balance mechanism working between the state and the Commission as a constitutional organ when their functions collide with each other. The 11 commissioners are appointed, not elected, in the similar fashion to the justices of the Constitutional Court and yet there is no constitutional device to keep the former neutral and independent from politics and ideologies when they work whereas there is such a device as the rule of law consisting in lawyers’ licence requirement for the latter to keep them neutral and independent in working. The Commission’s functions are multiple ranging from legislative, executive and judicial in their nature although they consist in investigation, study, research, education, opinion making, deciding, remedy, making mediation, etc. which do not carry legally binding effect in strict sense but de facto binding force. The Commission performs its functions free from the meddling of the National Assembly, the executive and/or the judiciary since the former is legally independent from the latters, but the former is able to meddle with the latters freely.
Further, the Commission ought not to be made a detouring vehicle to carry homo sexuality into constitutionally protected provisions both by way of making itself as constitution-created organ and of replacing yangsong pyongdung(both male and female sexual equality) with songpyongdung (gender equality, an innocently sounding terms in Korean ears) in the family institution related constitutional clause and of using songsosuja(sexual minority) and songjokjihyang(sexual orientation) in other constitutional contexts. All of songpyongdung, songsosuja and songjokjihyang include homo sexuality by implication. The Commission tries also to replace kukmin(a national) as the holders of the constitutionally enumerated rights and freedoms with modunsaram(all human beings or every one). The term modunsaram definitely include homos and also foreigners. The Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights use modunsaram as holders of human rights.
There may come the court’s decision that declares a homo sexual couple legitimate perhaps with the favorable changes of the peoples’ constitutional consciousness toward gays and lesbians as happened in other countries like the U.S. But legalization of homo couples and their providing in the written Constitution are two different things. Homo sexuality can not be said as belonging to the category of natural law and inherent natural rights that by definition cannot be created by the state. Thus far homo sex in the army where every able men have to serve has been subject to criminal punishment. Constitutional homo sex provisions will render the military penal code null and void. No doubt, spreading homo sexual culture will be a contributing factor to decreasing birth rates which are already underway in Korea. The decreasing birth rates have already led to decreased military manpower resources, to the arrival of old aged society, and to other things. The introduction of homo sex provisions in the constitution will undoubtedly be a powerful public endorsed countermeasure to the public interests for which the government recently endeavors to encourage the young men and women to get married and to give birth with increased social security measures such as birth allowance, child allowances, opening child-care centers, etc. Constitutionalization of homo sexuality ought not to take place.
Lastly, prejudice and possible discrimination against homo sexuality are being caused by no means by the lack of its friendly constitutional provision but a matter of its social recognition. The Constitution has a number of human rights friendly open clauses broad and flexible enough to accommodate homo sexual people under their protection if and when there arise changed social recognition toward them. Those clauses include Article 10 of human dignity and value and right to pursue happiness, Article 11 of equality under the law, Article 37 Section 1 of “freedom and rights ought not to be neglected even if not enumerated in the Constitution”, and others.
