The history of the United States spans only about 200 years, but European colonization and settlement began over 400 years ago. From the early days, not only were there autonomous and self-governing states, but various forms of local autonomy were also implemented. The loose central government in the early history of the United States, coupled with the challenges and compromises during the constitutional drafting process, led to the absence of clear provisions regarding the relationship between states and the federal government in the country's first federal constitution.
The theories explaining the relationship between state governments and local authorities include Dillon's Rule and Home Rule. However, the complex interactions between state governments and local authorities are not solely explained by these theories. Generally, states where Dillon's Rule is applied tend to emphasize strong state government authority, treating local authorities as creatures of the state. Conversely, states applying Home Rule, despite recognizing strong state government authority, tend to endorse a more enhanced system of local autonomy.
Even in states where Home Rule is applied, some have immediate application through constitutional provisions, while others require individual legislation for Home Rule application. Additionally, some states establish local relationships through specific provisions in state laws rather than constitutional provisions. Therefore, categorizing states simply as Home Rule or Dillon's Rule may be a hasty classification.
Furthermore, in states where Home Rule is applied, Dillon's Rule may still be applicable between local authorities and state governments. Even when Home Rule is generally applied, legal provisions in a state's laws may exclude or limit its application.
Examining the legislative distribution of powers between state governments and local authorities in the United States, contentious areas resemble those in South Korea. In various fields across the 50 states, state governments often preclude local legislation in specific areas, such as minimum wage in 28 states, regulations on paid leave in 23 states, anti-discrimination laws in only three states, and significant differences between state regulations on vehicle sharing (41 states) versus shared accommodations (only five states).
