日本国憲法における“憲法改正”と“憲法変動” = Comparison between the current constitution (Constitution of Japan (1946)) and the proposed constitution (LDP draft constitution (2012))

Constitution of Japan (1946) was promulgated on November 3rd, 1946, shortly after the end of the Second World War, and came into force on May 3rd, 1947. It is a "contemporary constitution", a relatively newer kind compared to other constitutions of the world. It is yet the longest-living unamended constitution, since there has been no changes from the original text of 1946. Indeed, Constitution of Japan has never been amended, not even for once. However, the past 70 years of constitutional history of Japan provides some important and meaningful insights in the field of comparative studies of constitutional amendments.
First of all, Japanese experiences suggest that constitutional changes can emerge without formal constitutional amendments. This introduces the concept of "kaishakukaiken" (interpretive amendment, de facto constitutional change through reinterpretation of the constitution).
Secondly, Japan's experiences can provide an opportunity to think about what makes a proper amendment, by reviewing the history of failed attempts. In post-war Japan, there has been several movements for the constitutional amendments, all of which were scuttled. The main reason for the frustration is that "the view on the constitution" itself was not appropriate. This view, played as underlying motives, includes 'reversion to the past (nationalistic amendment)' or 'true independence of Japan (anti-U.S. amendment movement)'. Those are the cases of constitutional law and a narrative (or even a nationalistic narrative) being confused. Also, the recent attempts of politicians trying to convey their political agendas in constitutional law is a case of confusion between "constitutional law" and policy "wish list". Aside from that, it seems like post-war constitutional amendment movements can be categorized into multiple types. There has been, for example, a reactionary amendment movement against the 'imposed constitution', a movement aiming at transforming Japan suitable for the global standard, and a movement to ratify the achievement of the interpretive amendment.
This paper is structured as follows. One needs to understand the birth of Constitution of Japan (1946) in order to understand the concept precisely. Therefore in SectionⅠ, I will revisit the unusual history of the promulgation of Constitution of Japan (1946). In Section Ⅱ, I will introduce the amendment procedure of the current constitution. And in Section Ⅲ, I will briefly cover the characteristics of the post-war constitutional amendment movements, as well as presenting the outline of the interpretive amendment. Finally in Section Ⅳ, I will add my personal remarks on the value of "post-war" and the constitutional amendment.
日本国憲法は、1945年に第2次世界大戦がおわった直後、1946年11月3日に公布され、翌年5 月3日に施行された。世界の憲法の中でも比較的新しい部類に入る現代憲法(contemporary constitutions)である。しかし、制定当時のテキストが一度も改正されたことなく、当時のままで ある憲法としては世界最古のものとなった。そう、日本国憲法は一度も改正されたことがない。し かし、戦後70年にわたる日本国憲法の歩みは、憲法改正の比較法にとっていくつかの重要で意 味のある視点を提供してくれるだろう。 まず、第1に、正規の憲法改正を経なくとも、“憲法変動”(constitutional changes)は起こり 得る、ということを日本の経験は示唆している。ここでは、“ 解釈改 憲”(kaishakukaiken)(interpretive amendment, de facto constitutional change through reinterpretation of the constitution)という戦略が紹介される。 第2に、憲法改正運動の挫折の歴史を回顧することにより、適切な改正とはどのようなもの かを考える契機を日本の経験は提供できる。戦後の日本で憲法改正運動が何度か試みられたも のの、それが成功しなかったのは、改正を求める動機に現れていた“憲法に対する見方”そのもの が適切なものではなかったことが挙げられる。ここでは、憲法改正の背景的な動機として、過去へ の回帰(ナショナリスティックな憲法改正)、日本の真の独立(反米的な憲法改正運動)が取り上げ られる。これらは、“憲法”(constitutional law)と“物語”(narrative)(しかも国粋主義的な物語)を 混同するものと言えよう。また、最近の政治家たちは、彼らの政策目標を次々に憲法に書き込も うとしているが、これは“憲法”と政策に関する“wish list”を混同するものと言えよう。これら以 外にも、戦後の改正運動にはいくつかのカテゴリーがあったように思われる。たとえば、「押しつ け憲法」に対する反動としての改正運動、日本を国際標準に適合した国にするための改正運動、 解釈改憲の成果を追認するための改正運動、等である。 本稿は、次のような順序で考察を進めていきたい。まず、日本国憲法を正確に理解するには、 まずその誕生について知っておかなければならない。Ⅰでは、かなり異例なその誕生秘話を簡単 に振り返る。Ⅱでは、現行憲法の改正手続を紹介し、Ⅲでは、戦後の憲法改正運動の特徴を大まか に振り返るとともに、解釈改憲の概要についても説明する。最後に、Ⅳにおいて“戦後”という価 値と憲法改正に関する私見を述べてみたい。
