전기자동차 사용 후 배터리의 반납제도 = A Legal Study on Return System for Used Batteries from Electric Vehicles

자동차에서 배출되는 오염물질이 수도권에서 발생하는 미세먼지의 약 30% 이상을 차지함으로써 자동차로 인한 대기오염의 심각성을 간과할 수 없게 되었다. 더불어 국제사회가 온실가스 배출 저감을 위한 노력을 촉구함에 따라 우리나라에 부여된 온실가스 감축의무를 이행하기 위한 다양한 제도적 수단이 강구되고 있다. 대기오염 개선과 온실가스 감축을 위하여 대기오염의 주된 원인으로 지목되는 내연기관차의 운행을 줄이고, 전기자동차의 보급을 확대하기 위하여 정부는 전기자동차 구매 시 보조금을 지급함으로써 전기자동차 구매에 대해 재정적 지원을 하고 있다. 정부의 이러한 전기자동차 보급 확대 노력을 통해 2012년 753대에 불과했던 전기자동차가 2019년 7만 8660대로 증가하였다.
전기자동차 운행이 늘어남에 따라 그와 관련한 새로운 문제들이 발생하고 있다. 전기자동차 폐차에 따른 전기자동차 사용 후 배터리의 증가가 그러한 문제 중 하나이다. 내연기관차의 경우 제조·운행·폐차에 있어 그에 적합한 체계가 구축되어 왔다. 현행 자동차 폐차 및 재활용 체계는 내연기관차를 중심으로 한 것으로, 전기자동차는 구조적으로 내연기관차와 다르기 때문에 기존의 자동차 폐차 및 재활용 체계를 전기자동차에 적용하는 것은 적합하지 않다. 따라서 전기자동차 폐차에 따라 발생하는 사용 후 배터리의 적절한 관리를 위하여 사용 후 배터리의 단순 폐기처리, 물질재활용 및 재사용·재목적화·재제조·재활용에 관한 법률적 기반이 필요하다. 다만 사용 후 배터리에 대한 물질재활용의 경우 「자원순환기본법」 등에 따라 물질회수가 이루어지고 있기 때문에 사용 후 배터리의 재사용·재목적화·재제조·재활용에 관한 법제도가 마련되어야 한다. 전기자동차 사용 후 배터리의 재사용·재목적화·재제조·재활용을 위한 법제도적 기반 마련에 있어서는 전기자동차 사용 후 배터리의 반납의무에 관한 법적 분석이 그 출발점이 되어야 한다. 「대기환경보전법」은 보조금을 지원 받은 전기자동차 소유자에 대하여 폐차를 위해 자동차 등록을 말소하고자 하는 경우 지방자치단체의 장에게 전기자동차 사용 후 배터리를 반납하도록 반납의무를 부여하고 있다. 전기자동차 보급을 위한 제도적 수단 외에도 「대기환경보전법」에서는 이미 배출가스저감장치의 부착, 저공해엔진으로의 개조·교체 등을 정하고 있고, 자동차 폐차 또는 수출 시 그에 부착된 배출가스저감장치 및 저공해엔진에 대하여도 반납의무를 두고 있다. 반납의무제도는 지방자치단체의 장이 배출가스저감장치 및 저공해엔진을 반납 받아 이를 재활용할 수 있도록 함으로써 보다 효율적인 예산집행을 하기 위한 것으로, 전기자동차 사용 후 배터리 반납의무의 경우에도 그 목적은 동일하다.
전기자동차 배터리는 평균 10년을 사용한 후에도 약 80%의 전기저장성능을 유지할 수 있다. 때문에 이를 활용한 전기자동차 사용 후 배터리의 재사용·재목적화·재제조·재활용 관련 사업은 경제성의 확보가 가능하다. 뿐만 아니라 정부로부터 재정적 지원을 받은 전기자동차의 사용 후 배터리를 재사용·재목적화·재제조·재활용함으로써 효율적 예산 사용을 도모할 수 있다. 전기자동차 보급 확대에 따른 사용 후 배터리의 증가에 적절하게 대응하기 위하여 사용 후 배터리의 재사용·재제조·재목적화·재활용이 필요하고, 이는 국가의 새로운 과제로 부상하고 있다. 현재로는 사용 후 배터리에 대한 반납의무제도를 통하여 일차적으로 사용 후 배터리를 효율적으로 수집할 수 있으나, 그 이후의 단계로서 수집된 사용 후 배터리의 가치가 적정하게 평가될 수 있는 성능평가체계가 마련되어야 한다. 다만 반납의무제도를 통한 재사용·재제조·재목적화·재활용 체계를 두는 것이 생산자책임재활용제도와 같은 다른 제도를 도입하는 것보다 적절한지에 관하여는 경제성 및 안전성 등의 다양한 측면에서 고려하여 판단해야 할 것이다.
The seriousness of air pollution caused by vehicles cannot be overlooked as the pollutants discharged from cars account for more than 30% of fine dust generated in the metropolitan area. Furthermore, as the international community seeks efforts to reduce greenhouse gas emissions, various systematical measures are being asked to fulfill the obligation to cut it in Korea. To reduce the operation of internal combustion locomotives, which are the leading cause of air pollution, and to expand the distribution of electric cars, the government provides financial support for electrical vehicle purchases by subsidizing to improve air pollution and cut greenhouse gases. With the government's efforts to expand the supply of electric vehicles, the number of electric cars, which was only 753 in 2012, increased to 7,660 in 2019.
The increased traffic of electric vehicles causes new problems. One of them is the increase in used batteries after scrapping the electric vehicle. The internal combustion locomotive has had an appropriate system established for manufacturing, operating, and scrapping. The current vehicle scrapping and recycling system was designed mainly for internal combustion locomotives, and electric vehicles are structurally different from internal combustion locomotives, so it is not appropriate to apply the existing system to the electric vehicles. Therefore, For proper management of the used battery wasted from the scrapping of the electric vehicles, a legal basis for simple disposal of the used battery, material recycling, and reuse, re-purpose, re-manufacturing and recycling are required. As the material is recovered according to the Framework Act on Resource Circulation in the case of recycling of the material after use, however, a legal system for reuse, re-purpose, re-manufacturing, and recycling of batteries after use should be prepared.
In preparing the legal and institutional basis for the reuse, repurpose, remanufacturing, and recycling of batteries after the use of the electric vehicle, the legal analysis of the obligation to return the battery after the use should be the starting point. Under the Air Environmental Conservation Act, the owner of an electric vehicle that has received subsidies is obliged to return the battery after using the electric vehicle to the head of the local government when canceling the vehicle registration for scrapping. In addition to the institutional means for distributing electric vehicles, the 「Air Environmental Conservation Act」 has already decided on the installation of an exhaust gas reduction device and conversion to low-pollution engines, replacement, etc. And the obligation to return is also specified for emission reduction devices and low-pollution engines attached to cars when they are scrapped or exported. The return obligation system intends for more efficient use of budget by allowing the head of the local government to receive and reduce the emission gas reduction device and low-pollution engine to reuse the battery, which purports to execute the budget through recycling efficiently.
Electric vehicle batteries can maintain an electrical storage performance of about 80% even after using an average of 10 years. With such points, the batteries can be reused, repurposed, remanufactured, and recycled after the use, and will be used in economical projects. In addition, the budget can be efficiently executed by reusing, repurposed, remanufactured, and recycling used batteries that have received financial support from the government. To respond to the increase of the used batteries due to the expansion of electric vehicles appropriately, it is necessary to reuse, remanufacture, repurpose, and recycle the used batteries, which is emerging as a new national task. Currently, it is possible to efficiently collect the used batteries firstly through the return obligation system, but as a subsequent step, a performance evaluation system should be prepared to evaluate the value of collected batteries properly. However, it is necessary to consider whether it is appropriate to have a system of reuse, re-manufacturing, re-purpose, and recycling through the return obligation system rather than introducing another method as producer responsibility recycling system from the economic and safety aspects.
