1. Issue
Then.? are Common surface reclamating Act and Small river servicing Act and etc., including River Law in our river related Acts of Parliament. Those has been revised several times after establishment, however still there are a few problems.
Most of all, there are lack of coordinating system in solving disputes between the persons concerned because the system of administrating river has been divided into administrational district unit. That mans, it is classified as river under the direct control of the government, river under local government, small river and so on. River under the direct control is administrated by Ministry Construction & Transportation and the rest of them are controlled by every administrational district, so it's very hard to keep consistancy to control water of upper and down streams and water system in a same way. Futhermore, main group of the administrating river is not under department of watersystem, so it can be ignored more than expected.
2. Projects and How to improve.
Idea of administrating river can be provided as limited public asset for nation, and river administrater has to fulfill thier duty for residents so that they can use water clean and safe. And also, river administrater has obligation to maintain the river clean for their next generation. If we think that administrating river is thoroughly trusted in basin residents, we also need to give an opportunity for them to participate in managing on their own. For that, we need river administratmg system in decentralized way, desperately.
In order to make these efforts available, first of all, we must reorganize administration of water managing organization into a basin unit, secondly, provide essential inquiry organization in local unit which is consisted in residental representitive, NGO and experts related in this field, finally, settle 'Basin water Council' (a tempral name) which is organized in locals to conduct coorperately the matter of river problems.
In addition, review the form of the ideal determination of the plan from local basin public organization and then appropriate 'Basin Water Management Policy' in 10-year-unit and 'Basin Management Plan' in 5-year-unit. Futhermore, local government should also appropriate 'Basin Management Plan' and must try to unite each local long-term plans and rules for tiding streets. About pro-environmental law and policies, it should be commited to rules so that each local public organizations can publish thier own law and policy.
Residental partisipational system in the field of river administration, in the step of the beginning, the river administrater has to show the basic data to the residents so that this can be the basical start leading to opened discussion or workshop with the related organizations to impose duty to the riveradministrater, and they must correct report for conference in base of results which the residents had offered.
Residents (includmg NGO) should able to suggest judgmental motion or plan deciding action as popular action.
Conformed actions, as they appropriate the plan, they regard it as dissolutional cause when they ignore considerable elements, for example, effections in ecosystem while accomplishing constructions or, opposite Occations that causes insufficiency in participating process of the residents or, mistaken error in the process of judging planning decretion.
Regulation of using land for controlling flood, start regulating as a rule, for example, zoning 'Water Protecting Area' or 'Wasted Water Area' in inside line of land bank and also should try ro make 'Dangerous Overflooding Area' in all boundery of the river.
To protect river ecosystem, not just regulate founding area to protect ecosystem but also conclude 'self managing treaty' between river administrater and land owner paying the price of land. Setting up regional right or, river administrater should enforce to act river renaturalizationing considering characteristic of the river. Purchasing the land outskirt of the river can be other way, too.
About necessarity for recompensating as they act the regulation for using land, it is alloweded to ristrict landownership for public reason and it is sensible to judge in case by case considering complexible elements where the specific situations are.
3. Future Planning
For the next project, we should check about founding water administration and ' General Water Managment Act'(a temporal name) not just for river act for the river area but for making it possible to maintain reasonable area according to circulation of floodgate, unifically.
