비록 간통죄와 같은 오래된 범죄는 현재 세계 각국과 인류역사상의 단계와는 관계없이 보편적으로 존재하지만, 중국 고대의 간통죄는 그 독특한 제도와 문화적 배경이 있다. 본문에서는 바로 중국 고대 간통죄를 대상으로 연구하였는데, 간통죄와 관련된 법률의 출현과 발전과정 및 법률 이후의 매우 특색 있는 문화요소의 정리를 시도하였다. 본문의 제1부분은 주로 발단 부분으로 우선 간통죄의 의미와 발생한 시간을 고찰 하였다. 출토된 秦의 죽간과 漢의 죽간을 통해 당시 간통죄의 법률규정에 관해 알 수 있다. 진나라 시기의 법률에서는 이미 和姦, 親屬相姦, 主奴相姦등에 대해서 그 사정을 나누어 형벌과는 다르게 규정하고 있고, 親屬相姦, 主奴相姦의 형량을 비교적 무겁게 하는 기초를 놓았다. 漢나라 시기의 법률은 한층 발전하여, 和姦과 強姦, 有夫姦과 無夫姦을 구분하였다. 唐나라 시기가 시작되면서, 사람들은 만약 小功이상의 친속이 姦하면 “十惡” 중의 內亂罪와 나란히 하였고, 또한 세밀하고 꼼꼼하게 親屬相姦, 良賤相姦의 각종 정황들을 구별하였다. 宋은 唐律을 계승하였는데, 宋나라 시기에는 姦生子女의 귀속적 규정이 보충되었다. 元나라 시기에는 간통죄를 하나의 단독으로 설정하고 많은 새로운 범죄정황을 규정하였다. 예를 들면 강제로 쇠약한 노인을 姦한 경우, 어린 여자아이가 姦을 당한 경우, 관리가 姦한 경우, 혹 강제로 아내와 첩에게 賣姦하도록 시킨 것과 姦夫를 눈감아준 경우, 姦婦가 남편을 죽인 경우, 정처의 정황을 들 수 있다. 明나라 시기의 간통죄는 간을 범하면, 강간과 친속상간의 처벌을 가중 시켰고, 刁姦의 규정을 추가시켰다. 淸나라 시기의 법률은 명나라 시기와 기본적으로 서로 동일하지만, 새로운 정황과 새로운 문제의 조항이 크게 증가하였다. 본문의 제2부분은 주로 중국 고대의 간통죄에 관한 법률제도 배후의 문화적인 부분을 탐구하였다. 유가사상을핵심으로 하는 중국 고대 사회는 하나의 윤리 본위의 사회이기에 고
대 사람들은 특히 명분과 윤리 도덕을 중시하였다. 여자의 정절에 대한 요구가 매우 높았기 때문에 만약 간음한 여자가 있으면, 자신의 정절을 잃을 뿐만 아니라 윤리 도덕의 커다란 파괴도 되었다. 그 다음은 인륜중시의 또 다른 표현인 服制에 대한 중시이다. 친속간의 범죄행위는 반드시 服制의 遠近에 따라 죄의 형량이 정해졌다. 기타 친속간의 범죄와 비교하면, 親屬相姦은 服制의 영향을 많이 받았고, 약간의 예외적 상황은 존재하였다. 본문의 제3부분은 청나라 말기 “有
夫姦”와 “無夫姦”의 논쟁을 본문의 끝부분으로 하였는데, 간통죄를 바라보는 시각을 검토하고, 중국 고대 법률 문화의 특징을 살펴보았다.
Although illicit sexual crimes are common in every country and every period of history, regulations and cultural background of this kind of crime in ancient China had many special features. Focusing on illicit sexual crimes in ancient China, this thesis aims to present the evolvement of law about illicit sexual relations and the fundamental cultural factors. In a chronologically order, the first part clarifies the meaning and emergence of illicit sexual crimes in the beginning. The information from the unearthed bamboo slips of Qin and Han Dynasty provides us laws at that time. In Qin Dynasty, the law had regulated different punishment to different kinds of illicit sexual crimes, especially punished illicit sexual relations between family members and between lords and servants severely. The laws in Han Dynasty distinguished adultery and rape, illicit sexual relations with married women and illicit sexual relations with unmarried women. From Tang Dynasty, illicit sexual relations with xiaogongyishang (similar to important and lineal) family members was considered as the most flagitious ten crimes. Besides, there were more divisions about different illicit sexual crimes between family members and between commoners and ragtag. Laws in Song Dynasty were copy to Tang’s and the only difference was a new rule about adulterine children. In Yuan Dynasty, illicit sexual crimes were classified to a group named Jianfei and many new crimes were regulated, for example, daughterin-law slandering father-in-law that he had raped her, young girl being raped, officials committed to illicit sexual crimes, husbands indulging or forcing wives to prostitute themselves, adulterers and adulteresses murdering their legal wives or husbands. In Ming Dynasty, the name of illicit sexual crimes was changed into Fanjian and punishment of rape and illicit sexual crimes between family members became more severe. The laws in Qing Dynasty were nearly the same to Ming’s, with a lot of new lis to cope with new situations and problems. The second part mainly studies on the cultural background of legal institution in ancient China. Firstly, the ancient Chinese
society was an ethic standard society which had the Confucianism as the core. Consequently, the ancients regarded ethic, status and reputation extremely important, with a high standard to women’s chastity. If a woman was related to an illicit sexual relation, she would be considered unclean and disgraceful. Secondly, attaching importance to Fuzhi is also a part of ethic. Crimes between family members were punished according to the kinship relationships. Compared to other crimes between family members, illicit sexual relations between family members was more deeply effected by Fuzhi. The third part, also the end of this paper, is about an famous argument on illicit sexual relations with married women and illicit sexual relations with unmarried women in the late Qing Dynasty, which displays some characters of ancient Chinese legal culture.
