In the event of a disaster in the United States, if it is determined that the disaster is beyond the ability of state and local governments to respond, the governor or chief local government officer conducts a Preliminary Damage Assessment(PDA). Federal, state, and local government officials conduct a Preliminary Damage Assessment(PDA) in disaster-affected areas to determine disaster recovery needs. Based on the results of the Preliminary Damage Assessment(PDA), the Governor requests federal disaster assistance through the Federal Emergency Management Agency(FEMA) regional offices. If the state, local, and Indian tribal governments exceed their ability to cope with disasters, the governor, local government chief, and Indian tribal chief may request the president to declare a disaster, proving that federal assistance is needed due to the severity of the disaster and the scale of the disaster damage. Accordingly, the president can declare a major disaster or emergency through comprehensive judgment.
There are three types of disaster recovery support in federal disaster recovery: first, Public Assistance(PA), second, Individual Assistance(IA), and third, Hazard Mitigation Assistance (HMA). In general, Public Assistance(PA) or Individual Assistance(IA) is not provided when insurance coverage or other beneficiary programs are operated for disaster damage. As U.S. federal disaster support program, Hazard Mitigation measures are intended to reduce or eliminate long-term risks to people and property from natural disasters, and play a significant role in long-term disaster response plans. The U.S.
federal government has established and operated a Disaster Relief Fund(DRF) that funds general disaster relief programs (response and relief activities following domestic emergencies and disasters). In general, at the request of the state, local, local, or Indian tribal governments, the president declares a disaster if an emergency exists or a major disaster occurs. Through this declaration of disaster, state, local, local, and Indian tribal governments can receive various disaster support programs, and many of these programs can be funded by the Disaster Relief Fund(DRF).
In Korean law, the Central Disaster and Safety Countermeasure Headquarters is established to oversee and coordinate matters related to the response and recovery of large-scale disasters and to take necessary measures. There are certain limitations in disaster response and management centered on such national committees or countermeasures headquarters. As a fundamental alternative, it is desirable to establish and operate an independent disaster safety management office. In addition, it is necessary to enact the so-called ‘Act on Disaster Relief Fund’ to efficiently support and compensate for disasters by creating necessary resources for disaster prevention, disaster preparation, disaster response, and disaster recovery.
미국에서 재난 발생시 미국 주정부와 지방정부가 자신의 재난 대응 능력을 넘어선다고 판단하는 경우, 주지사나 지방정부 최고책임자는 재난에 대한 사전피해평가(PDA)를 한다.
연방정부, 주정부, 지방정부 공무원은 재난 피해를 입은 지역에 사전피해평가(PDA)를 실시하여 재난 복구 수요를 결정한다. 주지사는 피해평가의 결과에 의거하여 연방재난관리청(FEMA) 지역사무소를 통해 연방에 재난 지원을 요청한다. 주(州)정부, 지방정부, 인디언 부족정부가 재난 대응에 있어서 감당할 수 있는 능력을 넘어서는 경우, 재난 발생의 심각성과재난 피해의 규모로 인해 연방 지원이 필요하다는 것을 입증하여 주지사, 지방정부 최고책임자, 인디언 부족 최고책임자가 재난 선포를 대통령에게 요청할 수 있다. 이에 대통령은종합적인 판단을 통해 중대재난 또는 비상사태를 선포할 수 있다.
연방 재난 복구 지원에는 첫째, 공적 지원(PA), 둘째, 개인 지원(IA), 셋째, 위험 완화 지원(HMA) 등 3가지가 있다. 일반적으로 재난 피해에 대해 보험 적용이나 다른 수혜 프로그램이 운영되는 경우, 공적 지원(PA)이나 개인 지원(IA)이 제공되지 않는다. 미국 연방 재난지원 프로그램으로서, 위험 완화 조치는 자연재난으로부터 사람과 재산에 대한 장기적 위험을 감소시키거나 제거하기 위한 조치이고, 장기적인 재난 대응 계획에 상당히 중요한 역할을 한다.
미국 연방정부는 일반 재난구호 프로그램(국내 비상사태 및 재해에 따른 대응 및 구호활동)에 자금을 지원하는 재난구호기금(DRF)을 설치운영하고 있다. 일반적으로 주정부, 지역정부, 지방정부, 인디언 부족정부가 재난 선포 요청을 하는 경우, 대통령은 비상사태가존재하거나 중대재난이 발생했다고 판단되면 재난 선포를 한다.
이러한 재난 선포를 통해주정부, 지역정부, 지방정부, 인디언 부족정부는 다양한 재난 지원 프로그램을 받을 수 있으며, 이러한 프로그램 중 다수는 재난구호기금(DRF)에서 자금을 지원받는다.
우리나라는 지방자치단체와 인접 지방자치단체 간에 재난원조협정 체결이 원활하게 되어 있지 않아 재난 대응 및 원조 등이 어려우므로, 지방자치단체와 인접 지방자치단체 간에재난원조협정 체결을 유도하여 재난 지원 협력체계를 갖출 필요가 있다. 또한 재난의 예방, 재난의 대비, 재난의 대응, 재난의 복구 등에 필요한 재원을 조성하여 효율적으로 재난의지원과 보상을 하기 위해 이른바 ‘재난구호기금법’을 제정할 필요가 있다.
