이 연구의 목적은 우리나라 사회보장사건 구제절차의 현황을 종합적으로 확인하고 보다 나은 사법 절차를 만들기 위한 정책적 시사점을 도출하는 것이다. 사회보장소송은 크게 사회보험소송, 공공부조소송, 사회보상소송, 사회복지 관련 소송으로 나눌 수 있으며, 사회보장사건이란 이와 같은 사회보장소송의 대상이 되는 사건이다. 우리나라 사회보장 소송 건수는 사회보장 소송이 활발히 이루어지고 있는 주요 국가들에 비해 현저히 적다. 이 연구는 그 이유 중 하나가 사회보장사건 당사자들의 사법접근성이 낮은 것과 관련이 있다고 판단한다. 사법접근성을 높이려면 무엇보다 실태에 대한 종합적인 파악이 필요한데, 이 연구에서는 절차면에서의 현황을 중점적으로 살펴본다.
연구 질문은 우리나라에서 사회보장사건들이 법원을 통해 어느 정도로 해결되고 있을까 이다. 여기에서 해결이란 사회보장과 관련해 제기된 이의가 충분히 고려되고 그에 대한 답변이 충분히 당사자를 향하고 있는가에 따라 판단될 수 있는데, 당사자가 절차를 수월하게 밟을 수 있어야 사안에 대한 판단을 받는 단계에 이를 수 있으므로, 일차적으로 이는 절차에 대한 접근성이 용이한지 여부로 판단될 수 있다.
연구 과제는 크게 다섯 가지이다. 첫째, 사회보장법의 체계를 검토하는 맥락에서 사회보장사건의 성격을 검토한다. 사회보장법 체계를 네 가지 영역―사회보험법체계, 공공부조법체계, 사회보상법체계, 사회복지서비스법체계―으로 구분해 사회보장사건의 특징을 정리하고, 주요 법률에서 구제절차가 규정되는 방식을 확인한다(제2장). 둘째, 사회보장사건 구제절차의 지형을 행정, 사법, 국제기구 등을 포괄하여 전반적으로 검토한다(제3장 제1절). 셋째, 법원에 초점을 맞추어 사회보장사건 관련 구제절차상의 현황과 특징을 검토한다(제3장 제2절). 넷째, 주요 국가(프랑스, 독일, 영국, 미국)에서 사회보장사건이 다루어지는 상황을 검토한다(제4장). 다섯째, 이들 네 가지 작업을 토대로 법원을 통한 사회보장사건 구제절차의 개선 방안을 도출한다(제5장).
첫째, 사회보장사건은 크게 사회보장법 체계에 따라 분류되며 그에 따라 구제절차가 규정되는 방식도 다소 다르다(제2장).
사회보장법은 “국가 혹은 공법인이 주체가 되어 개인을 생활위험으로부터 보호하는 것을 1차적인 목적으로 제공되는 급여관계를 규율하는 공법체계”라 할 수 있으며, 급여의 원인관 계와 입법목적을 기준으로 하여 사회보험법체계, 공공부조법체계, 사회보상법체계 및 사회 복지관련법체계로 분류할 수 있다. 사회보장사건에서의 권리구제는 법원에서 대부분 행정 소송을 통해 해결되고 있지만 일반적인 행정소송과는 구별되는 특수성을 띤다. 관련법이 복잡하고 방대할 뿐 아니라 개정도 잦아 전문가도 그 내용을 정확히 파악하기가 쉽지 않다. 그런데 다툼의 대상이 되는 행정결정은 당사자의 장기적인 법률관계를 결정짓는 경우가 많기 때문에 개인의 경제생활에 장기간 영향을 미친다. 사회보장사건의 당사자는 일반적 행정 사건의 당사자에 비해 이렇게 생존이 달린 문제를 놓고 다투기도 한다는 점에서 특별한 사회적 보호가 필요하다. 이러한 특수성을 감안하여 사회보장법적 권리구제에 관한 기본원칙은 권리구제 절차의 간소화, 분쟁의 단기 종결, 비용의 최소화, 분쟁담당기관의 전문화를 강조한다.
둘째, 사회보장 관련 권리구제 절차는 크게 행정을 통한 구제절차, 법원을 통한 구제절차, 그밖의 국내외 기구 관련 절차로 구분할 수 있다(제3장).
대부분의 사회보장사건은 일차적으로 이의신청, 심판청구 등 행정 영역에서의 구제절차를 밟는다. 행정을 통한 구제절차는 사회보장 관련 개별법에 따라 다소 차이가 있다. 이 연구에서는 사회보험법 영역의 「국민건강보험법」, 「국민연금법」, 「산업재해보상보험법」과 공공부조법 영역의 「국민기초생활보장법」, 사회보상법 영역의 「국가유공자 등 예우 및 지원에 관한 법률」, 그리고 사회복지관련법 영역의 「장애인복지법」에서 규정한 불복절차를 간략히 살펴보았다. 행정을 통한 구제절차는 법원을 통한 구제절차보다 간소한 이의제기가 가능하고 짧은 기간 내에 결과를 받아볼 수 있다는 점에서 장점이 있지만 절차가 기본적으로 개별법에 따라 규정되고 있어서 서로 다른 이의신청 및 특별행정신청 절차 간 체계화와 통합이 필요해 보인다.
법원을 통한 구제절차는 행정소송과 민사소송에서의 구제절차로 나누어 볼 수 있는데, 대부분의 사회보장사건이 행정소송으로 다루어진다. 행정소송에서의 절차는 소제기 방식, 관할법원, 제소기간, 소송대리, 소송비용, 심리방식, 가구제 제도 등으로 구분해 검토할 수 있다. 일반법원에서의 구제절차에 관하여는 장애인차별금지법상 법원의 적극적 구제조치 제도와 그 현황을 살펴보았다.
그 밖의 국내 구제절차로는 국가인권위원회 진정제도와 장애인차별금지법상 인정되는 법무부의 시정명령 제도가 있고, 법적 구속력은 없지만 개인진정 제도를 활용하여 국제기구에 호소하는 방법도 있다.
셋째, 사회보장 관련 분쟁을 다루는 세 가지 방식에 따라 외국 제도의 특징을 정리해 볼 수 있다(제4장).
사회보장법에 관한 분쟁을 대상으로 하는 권리구제의 방식은 세 가지로 유형화할 수 있다. 첫째, 사회보장법적 분쟁을 일반법원에서 관할하는 유형, 둘째, 사회보장법적 분쟁을 관할하는 전문법원을 설치하여 운영하는 유형, 셋째, 사회법적 분쟁을 원칙적으로 행정심판 기관에서 심사하여 결정하고 중대한 법원칙 침해 여부 등이 문제되는 경우에 한하여 법원이 관할하는 유형이 그것이다.
이 연구에서는 세 방식의 성격을 구체적으로 살피기 위한 사례로 프랑스(유형 1)와 독일 (유형 2), 영국과 미국(유형 3)의 제도적, 실천적 현황을 검토하였다. 각국의 정치경제 및 사법체제의 성격에 따라 각론에서 차이가 있으나 기본적인 원칙과 틀에서는 공통점이 보이는데, 둘 이상 국가의 제도들에서 발견되는 공통점은 다음과 같다. ① 소장 형식성을 완화하고 원고의 주소지를 기준으로 관할법원을 결정하는 등 사회보장사건의 당사자에게 간소하고 편리하며 쉬운 절차를 제공하는 것을 추구한다. ② 실효성 있는 권리구제를 위한 소송법적 제도, 예컨대 의무이행소송, 가구제 제도 등이 마련되어 있다. ③ 당사자가 최소한의 비용을 부담하도록 제도적으로 지원한다. ④ 구제절차의 일정단계까지는 변호사의 도움 없이도 당사자가 스스로 변론할 수 있도록 한다. 이를 위해 변호사가 아니더라도 법률에서 정한 일정한 자격(가족 등의 관계, 직장 관계, 공익활동단체 등)을 가진 사람이 사회보장사건의 당사자를 보조하거나 대리할 수 있는 기회를 보장하고 있다. 요컨대, 세 유형 모두에서 확인되는 것은 사회보장법적 권리구제는 일반소송과 구별되는 것으로 본다는 것이다. 이러한 틀에 따라 각국은 소송절차 간소화, 당사자 비용부담 경감, 당사자 참여 보장 등의 목표를 추구하고 있다.
이들 네 가지 작업을 토대로 의무이행소송제도, 가처분제도, 화해권고제도 등의 도입, 소송형식에 대한 다양한 선택지 제공, 원고친화적 소장 양식, 소송비용 감면 등을 제안하였다. 원고를 중심으로 정하는 관할법원, 비변호사소송대리허용, 완전참심제 등은 사회보장소송제도가 어느 정도 정착했을 때 도입하는 것이 바람직할 것으로 보인다. 법원 조직, 행정의 측면에서는 사회보장재판부를 단계적으로 설치하고 사회보장소송 관련 연수과정을 신설하는 것을 제안한다. 사회보장재판부가 설치된다면 세분화된 통계를 집계하는 것도 어렵지 않을 것이다. 아울러 현재 일부 법원에서 운영 중인 사법접근센터를 확충하고 장애인 등의 사회적 약자를 위한 지원을 실질화할 필요가 있다.
The demand for social protection is expected to grow due to social changes. We are experiencing changes in demographic structure, employment relationships, and family relationships. However, there has been little public awareness of social security cases in South Korea. Social security schemes should be based on the reason of State(la raison d'État), which guarantees the basic conditions of people's lives. Low awareness of social security cases seems to reflect relatively low public concern for the basic living conditions. Reviewing the procedures for social security appeals has the significance of preemptively preparing for the social security reform and reminding the responsibilities of the State of the people. The objective of this study is to provide a comprehensive overview of the current social security appeals procedures in South Korea and to draw policy implications for making better judicial procedures. Social security litigations in South Korea can be categorized into those related to social insurance, public assistance, social compensation, and social welfare. In order to increase access to justice, a comprehensive understanding of the current state is required. This study focuses on the status quo of appeal procedures. The research question is to what extent social security cases are resolved through courts in Korea. It primarily depends on whether the complaints and appeals process is clear and accessible. In order to answer the question, the chapters describe the nature and characteristics of social security cases reviewed in the context of examining the system of social security law (Chapter 2), the social security case appeals procedure, including administrative and judicial procedure (Chapter 3, Section 1), current status and characteristics of judicial procedures of social security appeals (Chapter 3, Section 2), and how social security cases are dealt with in developed countries (Chapter 4). The main findings of this study are the following: Administrative complaints and appeals about social security benefits are differently processed according to the relevant laws. In order to prevent any possible confusion, administrative complaints and appeals procedures are in the need for structural reorganization. In terms of judicial procedures, although most of the social security cases are resolved through administrative litigation in courts, they are distinct from general administrative litigation. Relevant laws are complex, vast, and frequently revised, which makes it difficult even for experts to accurately understand the contents. Parties to social security cases are especially in need of social protection as administrative decisions often have a long-term effect on their economic life (Chapter 2). Administrative remedies have advantages over judicial remedies in that simple objections are possible and results can be received within a short period of time. However, systematization between the procedures has yet to be achieved. Most social security cases are handled as administrative litigation in courts. In this study, administrative litigation procedures are reviewed focused on the method of filing a lawsuit, the court of competent jurisdiction, filing period, representation in litigation, litigation costs, etc. In terms of procedures in civil litigation, injunctions granted at the discretion of courts are recognized under the Act on the Prohibition of Discrimination against Persons with Disabilities. Other domestic remedies include the complaint process of the National Human Rights Commission and the order for correction from the Ministry of Justice, which are also recognized under the Act on the Prohibition of Discrimination against Persons with Disabilities (Chapter 3). There exist different types of courts that have jurisdiction over social security cases. In many countries, judicial courts handle social security cases (Type 1). Some countries have specialized courts (Type 2). Some others have administrative proceedings or tribunals handle most of social security cases and courts exercise limited jurisdiction. In this study, the cases of France (Type 1), Germany (Type 2), England and the United States (Type 3) were reviewed. While differences appear among them, many similarities are found in basic principles. Accordingly, two or more countries’ appeals systems share the following characteristics: - Simple, convenient, and easy procedures are provided for parties to social security cases. For example, complaint forms are easy to fill out and jurisdiction is conferred on the court of the domicile of the plaintiff. - Effective remedies are available. For example, interim measures and injunctive relief are granted by courts. - Claimants bear minimum costs of litigation. If they are unable to afford to pay for legal costs, they may apply for legal aid. - Until a certain level of the appeal process, plaintiffs are allowed to defend themselves without the help of an attorney. For this purpose, even if the person is not a lawyer, persons with certain qualifications (e.g., family relationship, workplace relationship, public interest group, etc.) governed by specific legislation are able to assist or represent the party in a social security case (Chapter 4). Based on the aforementioned findings, this study proposes the introduction of interim measures, injunctive relief and reconciliation recommendations in administrative litigations. It is also important to provide plaintiff-friendly complaint form in courts and make rules to minimize the cost of litigation for plaintiffs. Some of the ideas are for the relatively distant future. It would be desirable to adopt the system of jurisdiction conferred on the court of the plaintiff’s domicile, representation by non-lawyers, and lay assessor when the systems of social security adjudication and litigation are well-established. In terms of court organization and administration, it would be necessary to establish social security chambers in courts and training programs related to social security litigation in Judicial Research and Training Institute. Once the social security chambers are established, detailed statistics would become available as well. Lastly, it is necessary to expand the Legal Access Center in courts to substantially support the socially disadvantaged individuals.
