1. 제2차 세계대전 이후, 한국·중국·일본(이하 ‘한중일’)은 3국간의 정치적·역사적·이념적 갈등관계에도 불구하고 ‘이와는 별개로’ 경제적 협력관계를 꾸준히 구축해오고 있다. 3국간의 그러한 경제협력관계는 향후 ‘법의 영역’에서 자연스럽게 사법(司法)적 협력을 요구하게 될 것이고, 특히 사법(私法)의 영역에서는 거래 당사자 간에 발생하는 분쟁을 신속히 해결하여 손해배상을 ‘실현’하는 것이 사법(司法)적 협력의 주된 내용을 이룰 것이다.
그런데 3국간 거래 당사자들 사이에서 발생하는 사법(私法)적 분쟁을 오늘날의 법체계 하에서 해결하기는 쉽지 않다. 왜냐하면 어느 분쟁당사자 일방이 자국의 법원에 소를 제기하여 재판에서 승소하더라도, 그 판결을 가지고 상대방이 거주하는 다른 국가에서 집행하기 위해서는 판결에 대한 다른 국가의 ‘승인’과 ‘집행가능선언’이 필요하기 때문이다. 그러나 오늘날 3국간에는 그러한 ‘승인’과 ‘집행가능선언’을 위한 통합적인 법제도가 마련되어 있지 않다.
요컨대 이에 대한 시사점은 유럽연합이 오늘날 마련해두고 있는 ‘통합적 민사집행제도’에서 찾을 수 있을 것이다.
2. 유럽에 위치하는 국가들은 일찍이 정치·경제·사회·문화 등의 다양한 방면에서 통합을 이루고자 노력해왔으며, 유럽연합(EU)은 그러한 노력의 결과물이다. 특히 유럽연합은 그 형성·발전 과정에서 회원국 간 유럽연합 차원의 통합적 사법(司法)체계를 구축하기 위해 노력하였고, 이에 사법(私法) 영역에서는 통합적 민사집행제도를 마련해왔다. 유럽연합은 ‘브뤼셀 규칙(브뤼셀협약, 브뤼셀 I 규칙, 개정 브뤼셀 I 규칙)’을 수립하였고, 이와 더불어 ‘유럽집행명령에 관한 규칙’, ‘유럽지급명령절차에 관한 규칙’ 및 ‘유럽소액소송절차에 관한 규칙’ 등을 제정하였다.
유럽연합의 통합적인 민사집행절차에서 가장 두드러지는 특징은, 외국 법원의 판결에 대한 ‘승인과 집행’을 지속적으로 보다 간소화·신속화하기 위해 발전했다는 점이다. 즉, ① ‘브뤼셀 규칙(브뤼셀협약, 브뤼셀 I 규칙, 개정 브뤼셀 I 규칙)’에 의하는 경우, 어느 회원국에서의 판결을 다른 회원국에서 집행하기 위해서는 그 판결에 대한 다른 회원국의 승인 및 집행가능선언이 요구된다.
② 반면 ‘유럽집행명령에 관한 규칙’의 목적은 ‘집행채권에 대하여 다툼이 없는 경우’에 ‘당사자의 신청에 의해’ 당해 판결을 ‘유럽집행권원’으로 ‘인증’함으로써, 동 판결이 모든 회원국에서 ‘승인과 집행가능선언’ 없이 유통될 수 있도록 하는 것이다. 말하자면 유럽집행명령절차에 있어서는 다른 회원국에서의 ‘승인과 집행가능선언’이 생략됨으로써 그 회원국에서의 집행이 ‘브뤼셀 규칙’에 비해 보다 간소하고 신속하게 이루어질 수 있게 되었다.
③ 그에 반해, ‘유럽지급명령절차와 유럽소액소송절차’는 외국판결의 집행을 ‘유럽집행명령절차’보다 더욱 더 간소화·신속화하고 있다. 즉 두 절차에서는 유럽집행명령절차에서와 같이 판결에 대해 당사자가 ‘유럽집행권원으로서의 인증’을 신청하지 않더라도, 외국판결 그 자체가 ‘유럽집행권원’으로서 효력을 가지게 된다. 다만 두 규칙 간에 약간의 차이가 존재할 뿐이다.
이처럼 유럽연합이 오늘날 마련하고 있는 통합적 민사집행절차들, 특히 유럽 지급명령 및 소액소송 절차는 민사 및 상사사건에 관한 분쟁을 간소하고 신속하게 처리하기 위해 마련된 제도들이며, 이들은 한중일 3국간 통합적 민사집행절차를 마련함에 있어 시사점을 줄 수 있을 것이다.
3. 다만 향후 이른바 ‘한중일 지급명령 및 소액소송 절차’에 관한 규정을 제정하는 경우에는 유럽의 지급명령 및 소액소송 절차에 관한 규칙(이하 ‘두 규칙’)에 비추어 몇 가지 점들을 염두에 둘 필요가 있다.
① 두 규칙이 제정되기까지는 약 40년이라는 시간이 소요되었으며, 무엇보다 두 규칙은 회원국 간 ‘상대방 국가와 그 국가의 법체계’에 대한 신뢰를 전제로 탄생했다는 점이다. 이에 비추어 여전히 한중일 간에서는 정치적·역사적·이념적 갈등이 존재하고 있음을 부정할 수 없고, ‘상대방 국가와 그 국가의 법체계’에 대한 신뢰가 오늘날 3국간에 형성되어 있다고 보기도 어렵다. 이는 단시간에 해결될 수 있는 문제가 아니므로, 향후 3국간에는 우선적이고 단계적으로, 적어도 ‘경제협력’을 위한 사법(司法)적 신뢰관계를 구축하는 것이 필요할 것이다.
② 실제로 ‘한중일 지급명령 및 소액소송 절차에 관한 규정들’을 제정함에 있어서는 한중일 각국이 오늘날 마련하고 있는 각 지급명령 및 소액소송 절차들에 대한 비교법적 연구가 선행되어야 한다. 그리고 이를 전제로 오늘날 유럽의 두 규칙이 가지고 있거나 이들에 대해 지적되는 문제점들을 고려하여 전체적인 기본 형태와 절차단계별 요구되는 세부 조문들을 마련해야 할 것이다. 그러한 문제점들에는 예컨대 ‘변호사에 의한 대리 여부’, ‘소송목적의 값’, ‘인지액 등 수수료’, ‘표준양식과 언어적 문제’, ‘송달방식 또는 증거수집’, ‘항소절차’ 등이 있다.
③ 통합적인 지급명령 및 소액소송 절차의 운영에 관한 문제이다. 예컨대 유럽소액소송 절차의 활용도는 비교적 높지 않은 것으로 나타나며, 특정국가의 경우에는 연간 신청건수가 3건에 불과한 것으로 파악된다. 이러한 현실은 통합적 분쟁해결절차가 필요한지에 대한 근본적인 의구심을 갖게 한다. 따라서 한중일이 통합적인 지급명령 및 소액소송 절차를 운영하는 경우에는 유럽의 예를 참조하여 두 절차가 유용하게 활용될 수 있도록 해야 할 것이다. ‘국가 간 원거리 재판’이라는 특징을 고려할 때, 아마도 ‘원거리 화상심문’ 등이 용이할 수 있을 것이다.
1. Although Korea, China, and Japan have been struggling with political, historical, and ideological conflicts since World War II, the three states have nevertheless been steadily building economic cooperative relations. Such economic cooperation between the three states will consequently require judicial cooperation in legal matters; resolving disputes between transacting parties residing in different states to compensate damages expediently will be the main goal of judicial cooperation, especially in the area of private laws.
It is not easy to resolve private law disputes arising between the transacting parties residing in three different states under today's legal systems. This is because even if a party to a dispute files a suit in its domestic court and wins the trial, the judgment needs to be recognized and enforceable in other states where the other parties reside. However, there is no integrated legal system for such recognition and declaration of enforceability of foreign judgments between the three states today.
Since the European Union (EU) has established the integrated civil execution system, useful implications could be found by examining the EU system in place today.
2. European states have long tried to achieve regional integration in various fields such as politics, economy, society, and culture, and the EU is the result of such efforts. In particular, the EU has endeavored to establish an EU-level integrated judicial system among member states in the process of its formation and development, and accordingly, it has established an integrated civil execution system in the judicial field. The EU has established the Brussels Regulations (Brussels Convention, Brussels I Regulation, Brussels I Regulation (recast)) and, in addition, enacted the European Enforcement Order Regulation, the European Order for Payment Procedure Regulation, and the European Small Claims Procedure Regulation.
The most striking feature of the EU's integrated civil execution proceedings is that they have been developed to continuously simplify and accelerate the recognition and enforcement of judgments rendered by foreign courts. That is, (1) pursuant to the Brussels Regulations (Brussels Convention, Brussels I Regulation, Brussels I Regulation (recast)), the recognition and declaration of enforceability of another member state are required to enforce a judgment rendered by courts of one member state in another member state.
(2) By contrast, pursuant to the European Enforcement Order Regulation, for uncontested claims, a judgment can be circulated in all member states by certifying the judgment as European grounds for enforcement at the request of the party without the need for recognition and declaration of enforceability. Because the recognition and declaration of enforceability in other member states have been omitted in the European enforcement order procedure, the execution in the member states can be made simpler and faster than that under the Brussels Regulation.
(3) In comparison, the European Order for Payment Procedure and European Small Claims Procedure simplify and expedite the execution of foreign judgments even more than the European Enforcement Order Procedure. Under the European Order for Payment and Small Claims Procedure, a foreign judgment itself takes effect as a European ground for enforcement even if the parties do not apply for the certification as European grounds for enforcement of the judgment.
The EU’s integrated civil execution procedures, particularly the European Order for Payment Procedure and European Small Claims Procedure, are systems designed to simplify and expedite disputes in civil and commercial cases, which could provide implications in preparing for the similar integrated civil execution procedures between Korea, China, and Japan.
3. When the so-called “Korea-China-Japan Order for Payment and Small Claims Procedure” are enacted in the future, several points need to be kept in mind in deriving implications from the European Order for Payment Procedure Regulation and the European Small Claims Procedure Regulation (hereinafter referred to as the “Two Regulations”).
(1) The Two Regulations took about 40 years to enact, and above all, they were created on the premise of trust between member states in the other states and their legal systems. By contrast, it cannot be denied that there are still political, historical, and ideological conflicts between Korea, China, and Japan. Moreover, it is difficult to say that trust in the other states and their legal systems has been formed between the three states today. Since these are not problems that can be solved in the short term, the three states will, first and foremost, need to establish a judicial trust relationship for economic cooperation.
(2) Before the Korea-China-Japan Regulations on Order for Payment and Small Claims Procedure are actually enacted, comparative legal research on order for payment and small claims procedure in each state should be conducted. Based on that comparative legal research, the three states should establish the overall framework and detailed provisions required for each stage of the procedures, considering the problems that the Two Regulations have or will likely have based on the review of Europe today. Such problems concern, for example, representation by an attorney-at-law, the value of a lawsuit's object, fees such as stamp amounts, standard forms and linguistic issues, service methods or evidence collection, and appeal procedures.
(3) In operating the integrated order for payment and small claims procedure, measures to increase the utility of the procedures should be devised. For example, it appears that the frequency of use of European small claims procedure is not relatively high―only three applications per year in certain states. This raises fundamental doubts about the necessity of the integrated dispute resolution Procedure. Therefore, when Korea, China, and Japan operate the Integrated Order for Payment and Small Claims Procedure, European examples should be referenced so that measures to increase the utility of both procedures are devised. For example, holding remote video hearings could be considered as a convenient alternative in remote trials among different states.
