The Newspaper Law and the Publication Law legislated in 1907 and 1909 respectively, met divergent fates in the southern portions of post-liberation Korea under the American military regime: the former was readopted while the latter was nullified. This situation persisted through the establishment of the Republic of Korea as a separate state in 1948. The destinies of these two laws, which served as the legal pillars of the Japanese publication system during the colonial era, illuminate the hitherto understudied status of post-liberation censorship in relation to Japanese colonial censorship, at the very least, up until the Newspaper Law was abolished in 1952. To what extent were the legal and administrative setups and operations of censorship between the years 1945-1952 systematic? If so, what aspects of the post-liberation censorship system were inherited from the Japanese colonial system? In what sense did the latter system substantially depart from the Japanese colonial equivalent? Finally, how can one define the postcoloniality of post-liberation censorship as distinct from the coloniality of Japanese colonial censorship? With a view to articulating the key issues that arise from studies of post-liberation censorship in Korea, this paper offers the following three frameworks as tentative tools with which to explore the legacy of colonialism and new manifestations of the effects of division system, as well as the Cold War influence on practices of censorship in South Korea. The authors first identify the defining characteristics of Japanese colonial censorship in coloniality and modernity. These twin aspects continued to inform the new system of censorship from 1945 to 1952, to the extent that a thorough conceptualization of the colonial legacy should be prerequisite to any conversation on censorship. Second, the authors submit that the question of colonial legacy should not be contained merely within debates on continuity and discontinuity, but deliberated in juxtaposition with the U.S. government`s systematic reshaping of South Korea`s ideological terrain in response to Cold War pressures. Finally, the paper traces the incidents of censorship that involved the direct and coercive intervention of the South Korean government. While delineating these three state factors (Japanese colonial legacy; the U.S. military regime; and the ROK government) in the areas of censorship on journalism, literature, and film, this paper shows that the main object of state censorship shifts from the details of the material text to the public activities of the authors and their publication, individual or collective, more effectively towards a system that ultimately subtended the Cold War ideology and Korea`s national division.
