지침으로 정하는 건설일용직 건강보험 직장 가입자 기준의 문제점과 개선 방안 = Problems and improvement of the standards for construction atypical workers health insurance as prescribed by the Government Guidelines

현재 건설 사업장에서 1개월 이상 고용되어 1개월 간 근로일수가 8일 이상인 일용근로자는 국민연금 사업장 가입자 및 건강보험 직장 가입자 요건을 충족한다. 건설 사업장은 가입 요건을 충족한 근로자를 대상으로 각 공단에 취득 신고를 해야 하고, 보험료를 납부 해야 한다. 건설 일용근로자의 국민연금 및 건강보험 가입 기준은 국민연금의 경우 국민연금법 시행령 제2조 1. 가목에 규정되어 있고, 건강보험의 경우 보건복지부 「건설현장 건강보험 실무안내」 지침으로 안내되어 있다. 「건설현장 건강보험 실무안내」에서는 1개월 이상 고용된 건설 일용근로자가 1개월동안 8일 이상 근무하면 직장 가입자로서 건강보험 가입을 해야 한다는 구체적인 취득 요건이 기재되어 있다. 이에 반해 국민건강보험법 제6조에서는 ‘고용기간이 1개월 미만인 일용근로자’의 건강보험 가입을 제외하고 있을 뿐이다.
보건복지부가 발간한 「건설현장 건강보험 실무안내」 지침은 상위 법령의 별도 위임 없다. 해당 지침은 건강보험공단의 내부 업무지침으로 볼 여지가 있다. 하지만 건설 일용근로자를 고용하는 건설 사업장은 해당 지침에 따라 가입 자격을 충족한 일용 근로자들을 대상으로 건강보험 가입 신고를 해야 한다. 3년마다 실시되는 건강보험 지도점검에서도 공단은 해당 지침 기준에 따라 사업장이 건설 일용근로자의 건강보험 가입신고를 하였는지 여부를 판단한다. 건강보험공단은 건설 일용 근로자가 직장가입자로서 가입기준을 득하였음에도 불구하고 취득신고를 게을리한 사업장에는 최대 3년치 건강보험료를 부과한다. 따라서 해당 지침의 대외적 효력이 문제 된다.
대법원 및 하급심 법원은 「건설현장 건강보험 실무안내」 지침에 대한 법적 성격에 대해서는 판단하지 않고 있는 상황이다. 법원은 1개월 이상 근로를 제공한 건설 일용직 근로자의 건강보험 직장 가입자로서 자격 취득기준을 실질적으로 ‘상용직’으로 판단하여 인정하고 있다. 형식적으로는 일용근로자라 하여도 1개월 이상 사용자와 고용관계가 단절없이 계속되어 왔다면 상근성・계속성・종속성을 인정하여 상용직 근로자와 다름없어 건강보험 직장가입자로서 자격을 취득한다는 것이 법원의 입장이다.
그동안 법원의 판단들은 ① 「건설현장 건강보험 실무안내」 지침에 대한 법적 성격 및 대외적 효력에 대해서는 침묵하고 있다는 점 ② 일용근로자의 1개월간 근로일수가 4일~15일 이상이고, 1개월 이상 일을 했다면 고용형태의 상근성・연속성을 인정할 수 있다고 보고 있으나 보건복지부 지침은 1개월 이상 일을 했다고 하더라도 1개월간 근로일수가 7일 이하인 건설 일용근로자는 건강보험 직장 가입자 자격 취득 요건을 충족하지 못한다고 보고 있으므로 대법원의 판단과 보건복지부 지침 내용이 정확히 일치하지 않는다는 점에서 한계를 갖는다.
이와 같은 불일치를 해소하기 위해 국민연금이 그러하듯 건설일용근로자의 건강보험 직장가입자 가입기준도 법령에서 명확하게 정할 필요가 있다. 수년동안 법과 제도는 일용근로자의 국민연금・건강보험 직장 가입자 비중을 늘리기 위해 변경 및 제정 되어 왔다. 건설 일용근로자 국민연금 사업장 가입자 가입기준 시행령 도입과 변경, 보건복지부 「건설현장 건강보험 실무안내」 지침 내용 변경의 연혁은 건설 일용근로자의 직장 가입 기준 요건을 넓히기 위한 목적 ...
Currently, construction atypical workers who are employed at construction sites for more than one month and have more than eight working days for one month meet the requirements of subscribers to the national pension site and health insurance workplace. The construction site shall report the acquisition to each industrial complex for workers who meet the subscription requirements and pay insurance premiums. The national pension and health insurance subscription standards for daily construction workers are stipulated in Article 2.1.(a) of the Enforcement Decree of the National Pension Act, and in the case of health insurance, it is guided by the Ministry of Health and Welfare's guidelines. The Health Insurance Practice Guide for Construction Sites states specific acquisition requirements that daily construction workers employed for more than one month must subscribe to health insurance as a workplace subscriber if they work for more than eight days for one month. On the other hand, Article 6 of the National Health Insurance Act excludes health insurance subscriptions for “day workers with an employment period of less than one month”.
The guidelines for “Working Guide on Health Insurance at Construction Sites” published by the Ministry of Health and Welfare are not separately delegated by higher laws. The guidelines have room to be viewed as internal work guidelines of the National Health Insurance Service. However, construction sites that hire daily construction workers must report health insurance subscriptions to daily workers who meet the eligibility for subscription in accordance with the guidelines. In the health insurance guidance inspection conducted every three years, the corporation also determines whether the workplace has reported health insurance coverage for daily construction workers in accordance with the relevant guidelines. The Health Insurance Corporation charges up to three years' worth of health insurance premiums for workplaces that fail to report acquisition even though daily construction workers have obtained subscription standards as job subscribers. Therefore, the external effect of the directive is a problem.
The Supreme Court and lower court have not judged the legal nature of the guidelines for the “Working Guide on Health Insurance at Construction Sites.” The court recognizes the criteria for acquiring qualifications as a health insurance worker for construction daily workers who have provided work for more than one month, judging that they are practically “commercial workers.” Formally, the court's position is that if the employment relationship with the employer has continued uninterrupted for more than a month, it will qualify as a health insurance worker as it is no different from regular workers by recognizing full-time, continuity, and dependency.
Until now, the court's judgments have been silent on the legal nature and external effect of the guidelines for the Health Insurance Practice at Construction Sites ② The court judges that the number of working days of daily workers per month is more than 4 to 15 days, and if they have worked for more than 1 month, they can recognize the full-time and continuity of employment type. The Ministry of Health and Welfare's guidelines have limitations in that the Supreme Court's judgment and the Ministry of Health and Welfare's guidelines do not exactly match the requirements for daily construction workers with less than 7 working days per month.
In order to resolve such discrepancies, it is necessary to clearly set the standards for health insurance subscribers for daily construction workers in the law.
