Consumers are becoming more accustomed to and more comfortable with the electronic world.
Electronic transaction is changing the way consumers are relating to businesses. Consumers are now provided with more opportunities to access a greater variety of goods and services at lower prices as they discover a borderless virtual marketplace. The global nature of the electronic transaction eliminates some of the constraints of distance and time zones, and invites consumers to participate in an international marketplace that is generally accessible twenty-four hours a day, seven days a week.
But consumers are afraid that they might be cheated by virtual merchants on the network, that their personal data might be improperly collected and distributed, and that they cannot find goods and services they needed at the virtual shop.
As businesses and consumers expand their use of electronic transaction, the consumer protection issues which arises are becoming more important.
In order promote electronic transaction, we need to reassure the consumers by taking some measures to clear up such anxiety on the part of consumers.
The purpose of this thesis is to assist in the analysis and development of policies designed to ensure adequate protection to consumers in electronic transaction.
The reality of open networks and the prospect of widespread electronic transaction as a medium of choice for the consumer begs the question of whether current legislation is adequate to meet the basic needs of the online consumers. It is necessary to develop procedures aimed at building trust and confidence in consumers' mind in order to the development of electronic transaction.
This thesis attempts to answer this question and proposes options and recommendations to address the challenges faced by online consumers. This thesis identifies the key consumer protection issues as being misleading and deceptive practices and false representations, redress, location and identification of businesses, contractual issues and safety standards, as well as security of electronic payment system, privacy, and access issues. This thesis examines a range of strategies to support consumer protection in the electronic marketplace, such as consumer education, international networking, business self-regulatory activities, and monitoring of the market.
Chapter 3 of this thesis provides a general overview of contract law principles. Chapter 4 provides a summary of current legislation of general application that provides protection to consumers. More particularly, this part canvasses such legislation as the Unfair Business Practices Act, Consumer Protection Act. And, highlights gaps, inadequacies and ambiguities of current legislative schemes in the electronic transaction. These gaps, inadequacies and ambiguities are first set out on a legislation-basis. They are then organized along specific themes or issues of particular concern to consumers.
The themes identified above deal with issues concerning contract formation, formal requirement, jurisdiction, contract contents, misrepresentations, contract interpretation, 'cooling off' periods, the delivery of goods or services and redress mechanism. The final part of this thesis discuss how these issues might best be addressed and offers recommendations to deal with them.
Consumer confidence is crucial for the continued growth of electronic transaction. Consumers expect at least the same level of protections in the engage in global electronic transaction with confidence, internationally harmonized legal frameworks for dispute settlement and enforcement of remedies are necessary, especially taking into consideration the characteristic of electronic transaction that it is global and it cannot be controlled. And consumer education is essential if consumers are to become aware of potential risks and learn how to avoid them.
Protection mechanisms based on national schemes of regulation, which have functioned well while consumer transactions remained within national boundaries, may not adapt well to a borderless, virtual marketplace.
The best scenario for the growth and success of electronic transaction should be based on self-regulation.
In the electronic transaction, close dialogue between the private sector and governments, and international coordination is necessary. Business and consumer groups can work together to develop voluntary self-regulatory codes for protection of consumers. I urge governments to maintain a dialogue with industry to determine the appropriate mix of self-regulation by industry and legal frameworks by governments.
Electronic transaction should be industry-led and government should support industry by establishing the appropriate environment.
To be brief, Electronic transaction should be industry-led with minimum regulation.
