경제의 발전과 더불어, 환경을 보호하려는 목소리도 갈수록 높아지고 있으며 온실가스의 배출을 줄이고 재생에너지로 전통적인 화석연료를 대체하는 것은 거스를 수 없는 추세이며 세계 각국은 지속가능한 발전과 에너지공급을 보장하기 위하여 재생에너지를 발전시키기 위한 일련의 조치를 취하고 있다. 그러나 현시점에서 재생에너지를 개발하고 발전시키려면 막대한 비용이 소요되기 때문에 각국 정부는 재생에너지산업에 대한 보조금지원제도를 통해 자국의 재생에너지산업을 대대적으로 지원해주고 있다. 본 논문에서는 재생에너지의 정의와 가치에 대해 알아보고 각국이 재생에너지에 대해 보조금을 지원하려는 이유와 미국, 유럽, 한국 등 국가의 재생에너지 보조금지원제도에 대해 살펴보았다.
그러나 재생에너지산업을 발전시키기 위한 정부의 보조금제도는 적지 않은 통상 분쟁과 마찰을 야기하였다. 본 논문에서는 보조금협정 하의 보조금의 요건에 대해 알아보았는데 보조금은 (1) 정부로부터의 재정적 기여 (2) 그로 인한 혜택 (3) 특정성 등 3가지 요건을 충족할 때만 보조금협정의 규율을 받게 된다. 따라서 본 논문에서는 이러한 세 가지 요건에 입각하여 재생에너지 보조금과 관련된 첫 번째 사건이라고 할 수 있는 Canada – Feed-in Tariff Program 사안과 중국과 미국 그리고 중국과 유럽연합 간의 태양에너지 보조금에 관한 사례를 상세하게 검토하였다.
중국 역시 재생에너지 산업을 대대적으로 발전시키고 있고 그중에서도 태양광에너지산업에 대해서 막대한 투자를 하고 있다. 중국의 태양광에너지에 대해 발전차액지원제도, 자금의 공여, 세금관련 우대정책, 우대대출 등 보조금제도를 실시하고 있는데 본 논문에서는 이러한 보조금제도와 보조금협정의 합치 여부를 분석하고 현 시점 중국이 다른 나라와의 무역마찰에 대비하여 취할 수 있는 대응책을 제시하였다. 우선 중국은 응당 보조금제도가 보조금협정의 주요의무와 합치되도록 고안해야 하는 동시에 WTO 분쟁해결기구를 적극 이용하여 자국의 이익을 보호해야 한다. 또한 보조금협정에서 재생에너지와 관련된 규정이 부족하기 때문에, 이 공백을 채우고 무역과 환경사이의 균형을 맞춰나가기 위해서는 각국의 공동한 노력이 필요하다. 이 과정에서 중국은 대국의 지위에 걸맞게 국제 공조를 이끌어 내기 위하여 힘써야 할 것이다.
As the economy develops, the voice of people who try to protect the environment also increasing by day. The trend of reducing greenhouse gas emissions and replacing with renewable energy is becoming a mainstream that is difficult to ignore. Countries around the world are taking series of measures to develop renewable energy in order to ensure sustainable development and ample energy supply. However, at present, it is very costly to develop and advance renewable energy business, and so governments of many countries are
providing financial support for their nations’ renewable energy industry through subsidy system. This paper examines the definition and value of renewable energy and explores the reasons why each country is providing financial support for their renewable energy industry, and examines the subsidy system for renewable energy in the US, Europe and Korea.
However, the government subsidy system for the development of the renewable energy industry has led to considerable cases of trade disputes and frictions among countries. This paper examined the subsidy requirements under subsidy agreements, which are governed by subsidy agreements only when they meet three requirements: (1) financial contribution by the government, (2) relevant benefits and (3) specificity. Therefore, based on these three requirements, This paper studied in detail the first case related to renewable energy subsidies which is the Canada-Feed-in Tariff Program, and also the cases of solar energy subsidy between of China and the United States, and between China and the European Union.
China is one of the countries that are developing the renewable energy industry to a great extent and China invests heavily in the solar energy ndustry. Subsidy system for solar energy in China includes subsidies for feed-in tariff, funding and preferential tax treatment, and preferential loans. This paper analyzes whether such subsidy system in China is consistent with the subsidy agreement and proposes potential response measures China can take in preparation for future trade deficit with other countries.
First, China must consider and devise the subsidy system so that it is consistent with the main obligations of the subsidy agreement, while at the same time protecting the interests of its own by actively utilizing WTO dispute resolution mechanism. In addition, Since China lacks renewable energy related regulations in subsidy agreements, a joint effort by each country is needed to fill this gap and balance trade and environment. China should strive to bring international cooperation in line with its status as a great nation in this process.
