이 연구는 1945년부터 1964년까지 징병제의 제도적 발전과정과 그 영향을 고찰하는 것을 목표로 한다. 이를 위해 징병제에 관련된 주요 법안, 병무행정조직의 변천 과정, 징병제를 둘러싸고 전개된 사회적 논쟁의 역사적 배경과 그 과정을 고찰하였다.
1945년 8월 15일 해방과 함께 한반도의 38도선 이남 지역에서는 국민국가 수립 운동이 활발히 전개되었다. 군대 건설 논의는 국민국가 수립 운동의 일환이었다. 이 과정에서 주요 정치 세력들은 병역 제도에 대한 논의를 전개했다. 다수의 정치 세력이 징병제를 선호했다. 징병제는 본질적으로 국적을 가진 성인 남성 전체를 병역의무 대상자로 하는 제도였다. 병역 의무를 공정하게 부과하는 것이 징병제의 성공에 있어 중요한 요인이었다.
1948년 8월 대한민국 정부 수립과 함께 징병제 도입이 본격적으로 추진되었다. 한국 정부는 미국 정부의 반대에도 불구하고 군사력 증강과 징병제 도입을 추진했다. 그 결과 1949년 8월 6일 병역법이 공포되었다. 그러나 한국 정부는 미국의 군사원조 및 정부 예산 부족 등의 이유로 한국전쟁 발발 이전까지 징병을 실시할 수 없었다. 1949년 병역법은 일본 병역법을 모방한 법안으로 일본 병역법의 특징을 그대로 가지고 있었다. 그 중에서 고등교육 이수자에 대한 병역 특례는 병역기피를 비롯한 사회적 갈등의 요인이 될 위험성을 안고 있었다. 병역 특례는 국가가 국민을 목적에 따라 차등적으로 관리하는 성격을 가지고 있었다. 즉 국민개병주의에 반하는 요인이었다.
한국전쟁 발발과 함께 징병제가 본격적으로 시행되었다. 전쟁 초기에는 정부 조직과 병무행정기구의 붕괴로 인해 강제 징병과 같이 극도의 폭력을 동반한 방식으로 징병제가 운영되었다. 정부는 1952년 하반기에 들어서야 공식 행정기구를 통한 징집을 실시할 수 있었다. 한국전쟁 시기에 행해진 폭력적이고 무질서한 징병은 징병제에 대한 부정적인 인식을 확산시켰다. 전쟁을 계기로 광범위한 병역기피도 발생했다. 병역기피는 사회의 계급적 성격을 드러냈다. 사회의 최상층에 속하는 계급은 해외유학과 같은 합법적 방식으로 병역을 기피할 수 있었다. 병역기피가 특권화 되는 징후가 나타난 것이다.
1950년대 중후반 한국사회에서는 징병제 개혁에 대한 논의가 활발히 전개되었다. 징병제 개혁 논의의 핵심은 국민개병주의를 관철하여 남성 국민 전체에 병역의무를 평등하게 부과하는 것 이었다. 그러나 병역법 개정을 논의하는 과정에서 국민개병주의를 강조한 국방부와 고등교육의 중요성을 강조한 문교부가 대립했다. 그 결과 1957년 문교부의 입장이 반영된 병역법 개정안이 통과되었다. 1957년 병역법 개정안은 대학생의 특권을 유지해 국민의 반발을 샀다.
5·16쿠데타를 통해 집권한 군사정부는 자유당과 민주당 정부의 병무행정을 비판하며 국민개병주의에 입각한 징병제 개혁을 공언했다. 이에 따라 병무청으로 일원화된 병무행정 체계가 구축되었고, 주민등록제도를 통해 국민 개개인에 대한 통제를 강화했다. 그러나 군사정부는 해외유학생에 대한 병역특혜를 유지하는 모순적인 태도를 보였다. 제3공화국이 출범하면서 국가 발전이라는 목표에 맞춰 국민을 국가의 필요에 따라 위계화 하는 것이 고착화되었다. 이로서 국민개병주의는 형해화 되었다. 한국의 징병제는 강력한 제도적 장치와 국민을 분열시킬 수 있는 모순이 공존하게 되었다.
This paper aims to review the development of South Korea’s conscription system from 1945 to 1964 and examine the larger effect of such changes. For this purpose, the study looks into the main laws governing conscription, evolution of administrative organizations handling conscription, and also the historical backgrounds and developments of social debates surrounding the country’s conscription system.
Following the Korean Peninsula’s liberation from Japanese colonial rule on Aug. 15, 1945, there was active political and social movement in the southern half of the peninsula in support of constructing a nation-state. The nation-state movement included discussions about building a military and the country’s main political groups began debating the merits of different military service systems. The majority of the political groups preferred a conscription system. A conscription system would essentially draw from the country’s entire population of male adults who have nationality. Ensuring that military duties are imposed fairly and equally would be an important factor in determining the success of such a system.
Following the establishment of the government of the Republic of Korea in August, 1948, the Seoul government began a push for adopting a conscription system and strengthening the country’s military force despite opposition from the U.S. government. The efforts led to the proclamation of the military service law in Aug. 6, 1949. However, the South Korean government was unable to actually implement a conscription system before the 1950-53 Korean War due to issues including insufficient budgets and the dependence on the United States for military assistance. The military service law of 1949 was modeled after the Japanese military service law and shared its main characteristics. This included special treatment or exemptions for men who received high education, which risked social conflict over military service evasions and other issues. The special treatment and exemptions ran against the principles of universal conscription as it supported differentiated treatment of people by the state based on various purposes.
South Korea started to fully implement a conscription system after the eruption of the Korean War. During the early days of the war, the collapse of government and military administrative organizations left military officials relying on forced conscription that often accompanied extreme violence. It wasn’t until the second half of 1952 that the government was able to conscript troops into the military through official administrative institutions. The violent and unruly conscription during the Korean War spread negative public perception about the conscription system. There were widespread efforts among men to evade military services following the war and these efforts reflected social class characteristics. Men from the top-echelons of the society were able to legitimately evade conscription by enrolling to study overseas or through other ways. There were clear signs that the evasion of military services was becoming a form of privilege.
After the mid-to-late 1950s, South Korea saw active social debate on reforming the conscription system. The focus of the discussions was finding ways to reinforce the principles of universal conscription and fairly impose military duties on all South Korean males. However, the debates over revising the conscription law developed into a conflict between the country’s Ministry of Defense, which emphasized universal conscription, and the Ministry of Culture and Education, which stressed the importance of providing public motivation for higher education. In 1957, the conscription law was revised in a way that incorporated the Education Ministry’s position, which triggered public opposition over continued special treatment for college students.
The military government that took power after the coup of May 16, 1961, criticized the military service administration of previous governments led by the Liberal Party and the Democratic Party and vowed reforms based on the principles of universal conscription. All administrative activities regrading conscription were streamlined to go through the Military Manpower Administration. However, the military government also contracted itself by continuing special treatment or exemptions for students studying abroad. The inauguration of the Third Republic cemented the state practice of creating hierarchies among people to serve its needs and national development efforts. The principles of universal conscription became virtually obsolete. South Korea’s conscription system continued to carry contradicting characteristics as a strong systematic institution and a potential source of division between people.
