한중조세조약에 관한 연구 = A Study on the Korea-China Taxation Treaty
1994년 체결된 한중조세조약은 한중 양국 간의 경제발전과 교역증대에 크게 기여한 것으로 평가되고 있다. 그러나 최근 10여년 사이에 중국의 경제적 역량이 크게 성장하면서 사회주의 시장경제체제에 많은 변화가 발생하였을 뿐 아니라, 양국간의 교역규모와 인적?물적 교류가 확대되어 감에 따라, 과거 조약의 체결 당시에 미처 인식하지 못했던 여러 문제점들이 나타나기 시작하고 있다. 이에 따라 1994년에 체결한 한중조세조약은 현재 양국의 이러한 현상을 적절히 반영하지 못하고 있는바, 현재 한중조세조약은 양국의 경제교류의 보다 전면적인 확대와 발전에 기여하지 못하고 오히려 장애로 작용하고 있는 실정이다. 본 연구는 이러한 배경하에서 현행 한중조세조약의 규정을 OECD모델조약 및 현행 양국의 세법과 비교 검토하여 논의를 진행하여 다음과 같은 문제점을 지적하고 개선방안을 제시하였다. 첫째, 현행 한중조세조약에서는 동 조약의 적용대상자인 “인”을 “개인?기업 및 기타 인의 단체를 포함한다”고 규정하고 있으나, 그 중 “기타 인”에 관한 명확한 규정을 제정하지 아니하여 “기타 인”이 취득하는 소득에 대하여 조세조약을 적용하는 데 있어서 시비의 여지가 있는 것으로 보인다. 둘째, 현행 한중조세조약에서는 ‘부동산’을 당해 재산이 소재하는 국가의 법에서 가지는 의미를 가진다고 규정하고 있는바, 양국 간 ‘부동산’의 양도에 부과?징수되는 조세에 대한 양국의 규정이 상이하여, 한중 양국 간 동일한 부동산 소득에 대한 과세형평에 부합하지 아니한다는 문제가 제기되고 있다, 셋째, 한중 양국은 조세조약의 남용을 방지하고 과세당국이 국외의 원천소득을 파악하기 위하여 각국의 법률에서 거주자증명제도에 관한 규정을 도입하고 있으나, 정작 한중조세조약에서는 이러한 내용이 다루어지고 있지 아니하다. 이와 관련하여, 최근 한중 양국의 과세당국 모두가 주목하고 있는 수익적 소유자에 관한 규정 또한 조세조약에 명문화해야 할 것으로 생각된다. 넷째, 한중 양국 또한 아시아 역내에 존재하는 홍콩?라부안 등 역외금융센터를 통한 조세회피행위를 근절하고 국제간 새로운 조세질서에 부합하기 위하여는, 한중조세조약에 OECD의 TIEA 기준에 부합하는 정보교환규정을 신설하거나 별도의 조약을 체결하는 등의 대안을 마련해야 할 것으로 생각된다. 다섯째, 한중조세조약에서는 고정사업장에 관하여 OECD모델조약 등 규범성 문건에 기초하여 일반적인 사안에 대하여만 정의하고 예시적으로 고정사업장을 열거하고 있을 뿐, 고정사업장 과세원칙에 대한 큰 과제로 대두되고 있는 전자상거래에 관하여는 명시된 규정을 두고 있지 않다는 한계를 가지고 있다. 마지막으로, 한중조세조약에서는 ‘실질관리장소’?‘독립적 인적용역’?‘연금소득’?‘연예인 및 직업체육인의 소득’ 등에 관하여 명확한 규정을 두고 있지 않지만, 최근 양국의 세법개정 현황 및 인적교류관계를 고려할 때 관련 조문을 구체적으로 개정할 필요가 있다. 요컨대, 한중조세조약은 1994년 체결되어 현재까지 양국 간 조세문제를 해결하는 규범으로서 기여하여 왔으며, 한중 경제교류와 발전에 크게 기여한 것은 부인할 수 없는 사실이지만, 최근 10여 년간 중국 경제가 급속히 성장하였으며 양국의 인적?물적 교류가 지속적으로 확대되어 감에 따라 여러 가지 문제점이 드러나고 있는바, 한중 양국 경제협력의 더욱 전면적인 협력과 발전을 위하여는 한중조세조약의 전면적인 개정이 필요하다 할 것이다. 물론 조세조약은 국내의 규범이 아닌 국제간 규범으로서 상당기간 동안 그 안정성을 유지하여 예측가능성을 높이는 것도 매우 중요할 것으로 생각된다. 그러나 중국과 같이 세계역사상 전무후무한 인적?물적 규모를 갖춘 국가가 상상을 초월한 속도로 경제성장을 이어가고 있다는 특수한 상황과 머지않은 미래에 한중 FTA가 체결된다면 양국 간 경제거래와 인적?물적 교류가 폭발적으로 증가할 것으로 예측된다는 현실적인 당위성을 반드시 우선적으로 고려해야 할 것이다.
더보기Signed in 1994, the Korea-China Taxation Treaty (hereafter as “Treaty") is considered to have greatly contributed to the economic development and the increase in trades between two countries. But over the last 10 years, the economic capacity of China has seen a huge surge, which resulted in many changes in its socialistic market system. Furthermore, as the human resources and material exchanges as well as the size of the trades between the two countries expanded, various issues that had not been considered at the time of concluding the treaty began emerging. Since the treaty signed in 1994 does not appropriately reflect such phenomena between the two countries, it no longer contributes to the full-scale expansion and advancement of the economic exchanges, becoming an obstacle. As such, this study compared and examined the regulations of the treaty with the OECD model treaty and the taxation laws of each country, and pointed out, and proposed an improvement plan of the following problems: First, the current treaty defines “a party" the subject of said treaty, as “those that include individuals, companies, and organizations the other party.” However, it does not stipulate a clear definition of the “other party” which leaves room for dispute when applying the treaty to the income of the “other party.” Second, the current treaty defines “immovables” as the meaning that the law of the country in which said property resides. However, the regulations between the two countries differ in the tax imposed and collected on the transfer of “immovables”, and some question that it does not conform to the equity of taxation on the income from the same immovables. Third, while the two countries have introduced to the law the regulations on the certification of residence to prevent the abuse of the treaty and determine foreign source income, the treaty itself does not deal with this issue. In relation to this problem, it is believed that the regulation on the beneficial owner in which the taxation authority of both countries shows interest should be stipulated in the treaty. Fourth, to eliminate tax evading behavior through offshore financing centers in Hong Kong or Labuan or those that exist in Korea, China or Asia and to conform to the new international taxation order, it is believed that new information exchanging regulations should be enacted within the treaty or a separate treaty should be concluded that meets OCED’s TIEA standard. Fifth, the treaty is limited in that it defines only general issues and lists fixed businessesas an example based on normative documents, such as the OECD model treaty, and does not have clearly defined regulations on electronic transactions that have emerged as a huge task in relation to the taxation principle of fixed businesses. Finally, while the treaty does not have clearly defined regulations on “the actual control place”, “independent human resources services”, “annuity income”, or “entertainers’ and professional athletes’ income”, it is necessary to revise the related clauses in the treaty considering the recent conditions of the taxation revisions and the human resources exchanges between the two countries. In summary, while no one can deny that the treaty, having been enacted since 1994, has contributed to resolving various taxation issues and to the development of the economic exchange and development between the two countries, various problems have recently been recognized as the two countries continue to expand human resources and material exchanges. It is therefore necessary that a full-scale revision of the treaty be required to further the cooperation and economic development of the two countries. Indeed, it is believed to be crucial that not as a domestic, but an international regulation, the treaty maintain its stability and increase the predictability for a considerable time.
